  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Use automated systems (bots, scripts, scrapers) to access the Service without permission
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for commercial purposes, resale, or redistribution without authorization
  • Circumvent or attempt to circumvent rate limits, security measures, or file size restrictions

4.3 Rate Limiting

The Service implements rate limiting (10 requests per minute per IP address) to ensure fair usage and prevent abuse. You agree not to circumvent or attempt to circumvent these limits.

5. File Uploads and Processing

5.1 File Requirements

  • Supported Formats: MP3, M4A, WAV, MP4, MKV, OGG, FLAC, AAC, WMA
  • Maximum File Size: 100MB per file
  • Cover Art: JPG, PNG (maximum 10MB)
  • Files must be valid and not corrupted

5.2 File Validation

All uploaded files are subject to validation checks including:

  • File extension verification
  • MIME type checking
  • Magic bytes (file signature) verification
  • File size limits

Files that fail validation will be rejected. We reserve the right to reject any file for any reason.

5.3 File Processing and Storage

  • Files are processed automatically upon upload
  • Files are stored temporarily on our servers during processing
  • All files (input and output) are automatically deleted after 15 minutes
  • We do not guarantee file processing will be successful or error-free
  • You are responsible for backing up your files before upload

5.4 No Guarantee of Results

We do not guarantee that:

  • All file formats will convert successfully
  • Output quality will meet your expectations
  • Metadata will be preserved or editable
  • The Service will be available at all times

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to files you upload. By uploading files, you grant us a limited, non-exclusive, royalty-free license to:

  • Process and convert your files as requested
  • Store files temporarily on our servers (for up to 15 minutes)
  • Use files solely for the purpose of providing the Service

This license terminates automatically when your files are deleted (after 15 minutes).

6.2 Service Intellectual Property

The Service, including but not limited to its design, functionality, code, graphics, text, and software, is owned by MP3 Toolbox and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse engineer or attempt to extract source code
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our trademarks, logos, or brand names without permission

6.3 Third-Party Intellectual Property

The Service uses open-source software including FFmpeg. You are responsible for ensuring that your use of uploaded content does not infringe upon third-party intellectual property rights.

We respect intellectual property rights and expect our users to do the same. If you believe that content on our Service infringes your copyright, please contact us with:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing

  • A statement of good faith belief that the use is not authorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

We will respond to valid DMCA takedown notices in accordance with applicable law. Note that files are automatically deleted after 15 minutes, which may limit our ability to take action on specific files.

8. Disclaimers

8.1 Service Availability

We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. The Service may be unavailable due to:

  • Maintenance, updates, or technical issues
  • Server failures or network problems
  • Force majeure events
  • Actions by third parties

8.2 No Warranties

  • Loss or corruption of files during processing
  • Inability to process certain file formats or sizes

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MP3 TOOLBOX, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Cost of substitute services

11. Termination

You may stop using the Service at any time. Your files will be automatically deleted within 15 minutes of upload or processing completion.

11.2 Termination by Us

We reserve the right to suspend, terminate, or restrict your access to the Service, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Abuse of the Service or rate limits
  • Uploading prohibited content
  • Engaging in illegal activities
  • Any other reason we deem necessary to protect the Service or other users

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All files associated with your use will be deleted in accordance with our data retention policy (15 minutes). Provisions of these Terms that by their nature should survive termination will survive, including but not limited to disclaimers, limitations of liability, and indemnification.

12. Changes to Terms

We reserve the right to modify, update, or change these Terms at any time, at our sole discretion. Material changes will be indicated by updating the "Last updated" date at the top of this page.

Your Continued Use: Your continued use of the Service after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
